OFFICIAL RULES:

These are the official rules for this Promotion (“Official Rules”). By entering or otherwise taking part in this Promotion, you agree to be bound fully and unconditionally by these Official Rules, to follow all applicable rules and regulations, and to accept Sponsor’s decisions, which are final and binding on all matters relating to this Promotion.

Sponsor may reject or disqualify any Entry or Entrant, acting reasonably, if Sponsor determines that the Entry does not meet the requirements of these Official Rules, that the Entrant is not eligible, or that the Entrant has tampered with the entry process, broken these Official Rules, or behaved in a disruptive manner or in a way intended to annoy, abuse, threaten or harass anyone else. You must meet every requirement in these Official Rules to win a Prize.

ELIGIBILITY

You may enter this Promotion only if you:

• (a) are eighteen (18) years of age or older and have reached the age of majority in your state or jurisdiction of residence at the time of entry; and
• (b) are a legal resident of one of the 50 United States or the District of Columbia, excluding Florida, New York, Rhode Island, Guam, Puerto Rico and the U.S. Virgin Islands.

You are not eligible to enter if you are a current or former employee, officer, director, member, agent or representative of Sponsor or any of its affiliates, including AP Sound, LLC, Sweetwater Instrument Rental, LLC, Sweetwater Sound, LLC, Gear Nuts, LLC, Sweetwater Gift Co., LLC, Sweetwater Gear Exchange, LLC and Gator Cases, LLC. The same applies to your immediate family (parent, child, sibling, spouse and their respective spouses, wherever they live) and to anyone living in your household, whether related to you or not. This Promotion is void in any jurisdiction where it is prohibited or restricted by law, rule or regulation, and all federal, state and local laws and regulations apply.

HOW TO ENTER

There are two methods of entry:

1. Go to https://www.sweetwater.com/giveaway/ during the Promotion Period and fill out the entry form with all requested information; or
2. Send an e-mail to giveaway@sweetwater.com (Marketing Department) using the Subject Line $6K Performer Giveaway, and include your (a) name, (b) the name of the giveaway promotion (“$6K Performer Giveaway”), and (c) an indication of consent to be bound by these Official Rules.

No mechanically reproduced or photocopied entries accepted.

The e-mail method described in (2) above is the free alternate method of entry (“AMOE”), and all Entries received by either method are pooled together, treated identically, and have an equal chance of being selected in the Drawing.

Submission of the form outlined in (1) or e-mail outlined in (2) will result in one Promotion entry (“Entry”). Postcards and other mailed entries will not be accepted. Limit one (1) Entry per person throughout the Promotion Period, regardless of the method of entry. Entries that do not include all required information or that do not adhere to these Official Rules will be considered void.

If you enter using a mobile phone or other Web-enabled device, your wireless provider’s data rates may apply. Check with your provider for details on these and any other charges. You are solely responsible for any such wireless charges.

All Entries become the property of Sponsor and will not be acknowledged or returned. Sponsor is not liable for entries that are lost, late, misdirected, incomplete, garbled, incompletely received, mutilated, or illegible, for any reason.

PROMOTION PERIOD AND DRAWING OF WINNERS

The Promotion starts at 12:00:01 a.m. EDT on November 1, 2026, and ends at 11:59:59 p.m. EST on November 30, 2026 (“Promotion Period”). The Promotion is a game of chance, and the computer clock of the Sponsor will be the official time-keeping device in the Promotion. At the end of the Promotion Period, one (1) prize will be awarded to an eligible Entrant selected at random by Sponsor from among all eligible Entries received (the “potential Winner”). Odds of winning depend on the total number of eligible Entries received.

One (1) Winner will receive a Prize package (the “Grand Prize”) consisting of the following items:

The approximate retail value (“ARV”) of the Grand Prize package is $6,551.92 USD, which is the total of the individual item values listed above.

The maximum value that any single Entrant can win in this Promotion is $6,551.92 USD.

Prizes cannot be substituted or exchanged, including for cash, except that Sponsor may substitute a prize or prize item of equal or greater value if the stated Prize or any part of it is unavailable. Prizes are not transferable or assignable. Limit of one (1) Prize per person.

The random drawing described above (the “Drawing”) will take place within fourteen (14) days following the close of the Promotion Period.

Sponsor will ship the Prize within approximately ten (10) days after verifying the Winner. Sponsor will ship to the address the Winner provides during the verification process, using a delivery method and carrier that Sponsor selects.

You are solely responsible for all federal, state and local taxes, and for any other fees or costs associated with the Prize or with your receipt or use of it. If the ARV of the Prize is $600 or more, Sponsor will issue you an IRS Form 1099-MISC. Sponsor may require you to provide a valid social security number and a completed IRS Form W-9 before awarding the Prize. If you do not provide them, you will forfeit the Prize and Sponsor will select an alternate Winner.

WINNERS VERIFICATION

Sponsor will notify each potential Winner at the e-mail address provided in the Entry within two (2) business days of the Drawing, or as soon as reasonably practicable (“Prize Notification”). You will then have three (3) business days to respond. Sponsor is not required to try to reach you more than once. A potential Winner becomes a “Winner” only after Sponsor verifies eligibility. Sponsor may also require you to sign and return an affidavit of eligibility, a liability release and, except where prohibited by law, a publicity release within five (5) business days of the Prize Notification. You will forfeit the Prize if you cannot be reached, if you do not respond in time, if you cannot accept or receive the Prize for any reason, if you do not return any required documents on time, or if you have broken these Official Rules. If a potential Winner is ineligible or forfeits, Sponsor will select an alternate Winner at random from the remaining eligible Entries, up to three (3) times, after which the Prize may go unawarded.

REPRESENTATIONS AND WARRANTIES:

By participating in the Promotion, you represent and warrant as follows:

• All information provided by you in connection with this Promotion is truthful, current and accurate;
• You meet the eligibility requirements set forth in these Official Rules.

In consideration of the opportunity to participate in this Promotion, you irrevocably and unconditionally grant to the Sponsor a non-exclusive, gratis, royalty-free, freely assignable and transferable, freely sublicensable, worldwide and perpetual right and license to use, reproduce, publicly display, publicly perform, exhibit, transmit, stream, broadcast, publish, distribute, edit, modify, adapt, create derivative works based upon, and otherwise exploit (whether commercially or non-commercially) your Entry (including any text, photographs, or other content provided in the Entry such as Entrant’s name, address, and general and biographical information) in this Promotion, in whole or in part, across all media now known or hereafter devised, except where prohibited by law. Nothing in these Official Rules conditions the award of a Prize on the grant of publicity rights where such a condition is prohibited by law.

By submitting an Entry, you agree that Sponsor may contact you by telephone or electronically about this Promotion.

PRIVACY AND PROTECTION OF PERSONAL INFORMATION

Sponsor will collect and store certain personal information about you in order to administer and manage this Promotion and to comply with applicable laws, regulations and rules. This information includes, but is not limited to, your full legal name, address, e-mail address and phone number, together with general information about Winners. If you are a potential Winner, it also includes a social security number if Sponsor is required to obtain one.

CALIFORNIA AND COLORADO RESIDENTS — NOTICE OF FINANCIAL INCENTIVE

Sweetwater conducts a monthly giveaway on Sweetwater.com, a separate monthly giveaway on Gear Exchange, and other programs from time to time (collectively, the “Programs and Giveaways”). This Promotion is one of the Programs and Giveaways and may be considered a “financial incentive” under California law or a “bona fide loyalty program” under Colorado law. When you participate in this Promotion, we collect personal information from you, including, at minimum, your name and e-mail address, and often your phone number, along with other personal information that will be disclosed at the time of collection. We do not collect any sensitive information as part of this Promotion. We may share the personal information we collect with service providers who help us administer this Promotion and with our marketing partners, which may constitute a “sale” or “sharing” for targeted advertising in some states. We use and disclose your personal information to administer this Promotion, to communicate with you about this Promotion, for marketing, for internal business purposes, and to provide you with the benefits of this Promotion. The value of your personal information corresponds to the value you can receive from participation in this Promotion. For sweepstakes and giveaways, that value is equal to the cost of the prize divided by the total number of participants, and we calculate the value of your personal information based on our costs to provide this Promotion. By participating in this Promotion, you agree that the benefits are reasonably related to the value of the personal information you provide. You may enroll in this Promotion by entering as described in the “How to Enter” section above. You may opt out by submitting a request through our webform at https://www.sweetwater.com/privacy/request and by clicking the “unsubscribe” link in e-mails related to this Promotion.

GOVERNING LAW AND LIMITATION OF LIABILITY

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrants or Sponsor in connection with this Promotion are governed by and construed in accordance with the laws of the State of Indiana without giving effect to any choice of law or conflict of law rules. Entrants agree that any dispute arising out of or relating to this Promotion shall be brought exclusively in the state or federal courts located in Allen County, Indiana, and Entrants consent to the personal jurisdiction of those courts.

By participating, Entrants release and agree to hold harmless Sponsor and its affiliates, and their respective officers, directors, employees and agents, from and against any claim, injury, loss or damage arising out of participation in this Promotion or the acceptance, receipt, use or misuse of any Prize. Sponsor is not responsible for any typographical or other error in the printing, offering or administration of this Promotion, or in the announcement of a Prize. Sponsor makes no representation or warranty of any kind concerning the Prize, and all Prizes are awarded “as is” and without warranty, except that nothing in these Official Rules limits any manufacturer warranty accompanying a Prize item or excludes any liability that cannot be excluded under applicable law.

ENTRANTS AGREE THAT, TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS PROMOTION, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS, COLLECTIVE OR REPRESENTATIVE PROCEEDING OR AWARD; (2) ANY AND ALL CLAIMS, JUDGMENTS, SETTLEMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED THE APPROXIMATE RETAIL VALUE OF THE PRIZE, BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND EACH ENTRANT KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHT TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES OTHER THAN ACTUAL OUT-OF-POCKET EXPENSES, IF ANY, OR ANY RIGHT TO HAVE ANY DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) EACH ENTRANT’S REMEDIES WILL BE LIMITED SOLELY TO A CLAIM FOR MONEY DAMAGES, IF ANY, AND EACH ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. WHERE SUCH LIMITATIONS, WAIVERS OR EXCLUSIONS ARE NOT PERMITTED BY LAW, THEY DO NOT APPLY, AND NOTHING IN THIS PARAGRAPH LIMITS ANY MANUFACTURER WARRANTY ACCOMPANYING A PRIZE ITEM OR EXCLUDES ANY LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

If, for any reason beyond Sponsor’s reasonable control, the Promotion is not capable of running as planned, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, or any other cause that corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, Sponsor reserves the right, with the prior approval of Sponsor’s legal department, to disqualify any affected Entry and to suspend, modify, or terminate the Promotion and conduct the Drawing from among all eligible, non-suspect Entries received before the action was taken. Any change to these Official Rules once the Promotion has begun will be posted at https://www.sweetwater.com/giveaway/ and reflected in all Promotion disclosures.

If any provision of these Official Rules is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary and the remaining provisions will remain in full force and effect. Sponsor’s failure to enforce any provision of these Official Rules does not constitute a waiver of that provision. These Official Rules, as finalized before the Promotion is advertised, constitute the entire rules governing this Promotion and supersede any inconsistent statement in any advertisement or Promotion material.

WINNERS LIST
